1. General

These Terms and Conditions apply to all products and services offered by Lockwood Avenue, both through our physical stores and online channels. By using our services, you agree to these terms.

 


 

2. Orders

2.1. Placing Orders:

When placing an order, whether in our physical store or online, you agree to the prices, product availability, and any applicable shipping costs at the time of purchase.

2.2. Cancellations:

We reserve the right to cancel or refuse an order for any reason without explanation.

 


 

3. Payment

3.1. Payment Options:

We accept payments via various methods, including credit cards, debit cards, and online payment methods listed on our website. In our stores and on Lockwood-Avenue.com, payments are processed through Mollie, ensuring secure payment options.

3.2. Payment Security:

All payments are securely processed using SSL encryption. For each order, you will receive a confirmation email once the payment has been successfully completed.

 


 

4. Shipping and Delivery

4.1. Shipping:

We strive to ship all orders within the indicated time. External factors such as transportation delays, unforeseen weather conditions, or other circumstances beyond our control may impact delivery times.

For customers in Belgium and the Netherlands, 99% of orders are delivered the next day, provided the order is placed on time. The shipping times shown during checkout are indicative only; no rights can be derived from these estimates.

4.2. Delivery and Risk:

The risk of loss or damage to products passes to the buyer upon delivery.

4.3. Automatic Return:

If a package is automatically returned due to an incorrect address or a missing name on the mailbox or doorbell, we offer the following options:

  • You can pay the shipping costs again and provide the correct address or name, after which we will resend the package.
  • You can receive a refund for your order, minus the return costs we incurred for the automatic return.

If you refuse a delivery or fail to pick up your order from a pick-up point, the package will automatically be returned. The refund will be reduced by the return costs (which may be higher than standard shipping fees), plus an administrative processing fee of 15% of the total order value.

4.4. Outside the EU:

For deliveries outside the European Union, any customs duties, clearance fees, import taxes, and VAT are the responsibility of the buyer. Please consult your local regulations for more information.

 


 

5. Returns and Exchanges

5.1. Return Policy (Physical Store for Consumers):

Items purchased in our physical store by consumers can be returned or exchanged for another product or a gift card within 7 days. Cash refunds are not available. For business customers, see Article 5.4.

5.2. Return Policy (Online Purchases by Consumers):

For online purchases by consumers, a 30-day return period applies, except for products listed under Article 5.3. You may choose to return your item via our return portal or bring it personally to our store. Refunds will be processed using the same payment method as the original order. For business customers, see Article 5.4.

For customers outside the EU: A correct proforma invoice must be provided when returning products. Failure to provide this may result in additional charges. These extra costs may include:

  • Customs and administrative fees: If customs receive a return shipment without the correct documentation, additional administrative and storage fees may apply. In some cases, VAT or import duties may be incorrectly applied, resulting in extra costs.
  • Storage costs and delays: If a return shipment is held by customs due to missing or incorrect information, storage fees and delays may occur, significantly slowing the return process.
  • Return shipping fees: If customs cannot process the return due to missing information, the package may be returned to the country of origin, with additional return shipping fees charged.

5.3. Specific Return Conditions for Certain Products:

Nike SB Dunks and Launch products purchased online can only be returned within the legally required 14-day period. After this period, returns are no longer possible.

5.4. Return Conditions for Business Customers:

Business customers are not entitled to the statutory 14-day withdrawal period as consumers are. Returns are only accepted if contractually agreed upon in writing before the order is placed or in the event of a manufacturing defect. Before placing the order, all return procedures and costs will be agreed upon. Return requests made after the order without a pre-agreed return right will not be accepted.

Business customers must return the product at their own cost unless otherwise agreed in the contractual terms. This policy strictly applies to resellers, particularly for products such as Nike SB Dunks and Launch products, to prevent misuse of the return policy.

 


 

6. Questions and Complaints

For questions or complaints, you can contact us at [email protected]. We aim to respond and resolve complaints within 7 business days. Filing claims directly through PayPal does not contribute to a speedy resolution, and we recommend contacting us directly for faster processing.

 


 

7. Intellectual Property

All trademarks, logos, and brand names appearing on our services are the property of their respective owners. The content of our services, including text, images, and videos, is protected by copyright and may not be reproduced without written permission.

 


 

8. Limitation of Liability

We are not liable for any indirect, incidental, special, or consequential damages. Any visible damage or quality defects of a product, or other defects upon delivery, must be reported within 24 hours of delivery. Failure to do so may result in the loss of your rights.

 


 

9. Warranty

9.1. Consumer Warranty (Legal Warranty):

For consumers, the legal warranty applies as defined by the law of 21 September 2004 on the protection of consumers in the sale of consumer goods. This warranty covers manufacturing defects and material failures and applies for two years from the date of purchase.

9.2. Business Warranty:

For business customers, a 6-month warranty applies. This warranty only covers manufacturing defects and material failures. Normal wear and tear, improper use, or modifications to the product are not covered under the warranty. Lockwood Avenue reserves the right to repair or replace defective products.

 


 

10. Applicable Law and Jurisdiction

These terms are governed by Belgian law. Disputes arising from agreements covered by these terms will be submitted to the competent courts in Antwerp, Belgium.

 


 

11. Order Modifications and Cancellations

Orders cannot be modified or canceled after being placed. For returns, see Article 5.

 


 

12. Invoice and Address Changes

After placing an order, invoices and shipping addresses cannot be changed. Please ensure all details are correct at the time of ordering.
